5 Steps to Take Immediately if You or a Loved One is Arrested

June 11, 2025 by Sam H.

Getting arrested is something no one wants to face, but it can happen, sometimes when you least expect it. Whether it’s you or someone you care about, the way you respond in those first few hours can have a huge impact on the situation.

Panic, confusion, and fear are all normal feelings. Still, even in that moment, a calm and informed approach can make all the difference. Below are crucial steps you should take right away if you or someone close to you has been arrested.

Step 1. Remain Calm and Speak as Little as Possible

This may seem easier said than done, but it is very important to remain calm.

*       Do not argue with the officers.

*       Do not yell or run away; it only makes the situation worse.

*      Even though you may feel that the arrest is unjust, please comply as well as remain still.

You have the right to remain silent, and you should exercise that right now. You should only say what you absolutely must, things like your name. Do not try to explain the events that have unfolded or offer your take on the situation. Quite frankly, anything you say can be used against you later. Whatever you say at this moment will not be of any help to you.

Step 2. Ask for a Lawyer Right Away

Once you’re in custody, ask for a lawyer right away. This step is not only for guilty people. This step is needed by all seeking rights protection.

You must speak to some legal counsel prior to answering any such questions. Before seeking advice, you should also refrain from signing any documents or statements. Police might seem friendly or take actions so you feel like talking helps. Their job is to gather evidence. They are not present so as to provide assistance to you, however.

If you’re in Edmonton and need urgent legal support, connecting with a trusted professional like Liberty Law criminal lawyer Edmonton can help you get the right advice and protect your rights from the start. They’ll explain what you’re being charged with, walk you through the legal process, and speak on your behalf during questioning or hearings.

More importantly, they’ll examine how the arrest occurred and investigate for any errors or rights violations. This can make a big difference in how your case moves forward. Getting legal help early means fewer chances of making mistakes that could hurt your case.

Step 3. Try to Remember Everything You Can

Details matter, especially later when your lawyer is working on your defense. As soon as you’re able, try to write down or remember:

*      The exact time and location of the arrest

*       What the officers said to you

*       If you were searched, and how

*       Names or badge numbers, if possible

*      Anyone who was there and may have seen what happened

Even small things can help build your defense, especially if there’s any question about how the arrest was handled.

Step 4. Let Someone You Trust Know What Happened

If you’re allowed a phone call, use it wisely. Reach out to a close family member or a trusted friend who can support you in practical ways. They can help you find a lawyer, gather information about bail, and keep your loved ones informed.

But be careful! Don’t talk about the details of your case over the phone. Jail calls are often recorded, and anything you say could be used against you later. Keep it simple: let them know where you are and that you need legal help.

Step 5. Follow All Legal Advice and Conditions Closely

Once you’re released, stick to every rule and condition given to you. If you’re out on bail:

*       Don’t miss any court dates.

*       Don’t break any of the bail terms.

*       Don’t talk about your case on social media.

*       Stay in touch with your lawyer and follow their advice exactly.

Even small violations can lead to being taken back into custody or weakening your defense. This is the time to be extra careful and responsible.

And Now, What Not to Do After an Arrest

Knowing what to do is helpful, but knowing what not to do is just as important. Here are a few mistakes that can make your situation worse:

*      Don’t try to lie your way out. Lying to the police or giving false information can bring more charges.

*       Don’t post about your arrest online. It might seem like a way to vent, but those posts can be used in court.

*       Don’t try to contact the victim or witnesses. This could look like intimidation or tampering, even if that’s not your intention.

*       Don’t ignore court documents or legal notices. They won’t go away, and missing a court date can lead to another arrest.

Staying quiet, smart, and respectful will help your case more than trying to fix things on your own.

Final Thoughts

Getting arrested is overwhelming, but you’re not helpless. These five steps, staying calm, asking for a lawyer, keeping track of details, contacting someone you trust, and following legal instructions, can give you some control over the situation. If it’s your loved one who’s been arrested, share this guide with them and be the person who helps them move forward with clarity. A calm and quick response can help avoid a lot of problems down the road.
