Ways a Business Lawyer Helps in Starting a Business

October 25, 2016 by Sam H.

Ways a Business Lawyer Helps in Starting a BusinessHaving a trusted business lawyer such as Cliff Schneider (or amending this to your local area) by your side as you start your business sets a solid legal foundation for your business. It is important to engage a legal mind from the onset as it saves you from a lot of trouble down the line as you try to legalize your business. A legally set up business goes a long way in increasing the credibility of your business as well.

The success of this plan of course will lie in engaging the services of a lawyer that specializes in business law. This will make a big difference in how you set up your company as well as how you operate. Below are ways through which a legal expert will help you in starting of your business:

Business registration and Structure

A lawyer with an expertise in business law will help you in setting up your company. You will get assistance in registration of your business. In most cases, this process requires careful checks to ensure that no infringement on other companies’ names happens. A legal expert will help you in carrying out the search as well as ensuring the right steps take place.  In addition, the business lawyer will help you in setting up the company structure and drawing up all the right papers for this.

Drawing up of contracts

A successful business will require use of the right contracts. The contracts are important as they legally bind you with other parties. Even a slight error in the wording can cost you a lot of money in future. Your business will need different types of contracts that will help in its running. These include employment contracts as well as contracts for provision of goods and services. As a startup, you will also get contracts to sign from other parties and a legal expert will help in verifying that they do not leave you open to lawsuits or losses in future.

Lease and property sale documents

As a new business, you may opt to lease the commercial space for either offices or stores. To safeguard your interest, a lawyer will go over the lease and help identify clauses that may be risky for you. In case you are unable to change the standard lease, the lawyer will help you draw a tenant addendum to add to the original document. If you opt to buy your property, then the legal expert will help you with the sales agreements and ensure that they are fair to you.

Intellectual property issues

If your business is riding on a unique concept or product, then getting a patent is important. It will protect your idea from infringement by other parties. A legal representative conversant with the process will help you get it right and therefore protect your inventions. You will be able to capitalize fully on your trademarks and brands as well without fear of any legal trouble.

Tax matters

Taxation is an important issue for any startup. A legal representative will help you in identifying your tax limits. Pick a lawyer familiar with tax laws in your niche. This information will come in handy as you will pay all the right taxes within the limits set by the law.

There is so much that goes into starting a business that I can imagine how overwhelming it would be. Contracts and tax issues must get very complicated and having someone knowledgeable to assist would be so important.
